2007 Stallion Service Auction Agreement

The auction shall be governed by the following terms & conditions: 

1.   The 2006 Stallion Service Auction (SSA) will be conducted via US mail & e-mail.  E-mail bids will be accepted, but should be followed by the paper copy bid form & minimum bid payment, with-in 5 days. Non receipt of payment will render your bid invalid. 

2.   The minimum bid shall be one half of the posted breeding fee unless otherwise indicated. 

3.   Bidding begins Nov. 15th, 2006 and will close Feb. 15th, 2007.  Any breedings not sold by Feb. 15th  will remain on sale for 1/2  the regular breeding fee until June 1st.

4.   Bids MUST be received by the deadline to be accepted. QPA is not responsible for bids not received in time. 

5.   The stallion services offered in this auction are intended for the 2007 breeding season. 

6.   Bids are binding and cannot be withdrawn after Feb.15th, 2007. A bidder may bid on any number of stallion services, however by placing a bid you are making a legal contract between yourself and the QPA. If you are the winning bidder payment WILL be expected. THERE WILL BE NO EXCEPTIONS.  

7.   In case of tie bids for one stallion service, the earlier received bid will be the winner. 

8.   The stallion owner has the right to refuse any mare in poor condition, that is vicious, not halter broke, or if contract stipulations are not met. The winning bidder agrees to abide by the terms of the stallion owner’s breeding contract, and the QPA does not assume any liability for any disputes between the bidder and the stallion owner. 

9.   QPA strongly suggests that bidders contract stallion owners BEFORE bidding and to become familiar with the breeding contract, terms and expenses involved with the stallion services on which they bid. 

10. Payment for minimum bid should be submitted with the bid form. Checks will be held & returned to non-winning bidders un-cashed. I cases where fee exceeds the minimum bid QPA will invoice winning bidder. These fees should be paid within (5) days of the close of the auction. Failure to remit fees in a timely fashion will be cause for forfeiture of your bid, in which case the next highest bidder will be declared the winner.  All other fees (mare care, vet care, chute fees etc…) are to be paid to the stallion owner in accordance with their contract. No mare will be serviced until payment in full is received by QPA. 

11.  NO REFUNDS WILL BE GIVEN UNDER ANY CIRCUMSTANCES!
